Embezzlement Penalties
Embezzlement can happen in various circumstances. In California, penalties for the offense is determined by the type or value of the property, or the amount of money which was stolen.
Money or property worth less than $950 is considered a misdemeanor, punishable by a jail sentence of up to six months and a maximum fine of $1,000. However, if the money or property is worth less than $50, it is considered an infraction that is punishable by maximum fine of $250.
Money or property worth more than $950 is considered grand theft, which is punishable by either a maximum jail sentence of one year or a prison sentence of 16 months, two, or three years. However, if an offender was convicted during the same criminal trial of two or more felonies involving embezzlement or fraud – which in combination caused the loss of more than $100,000 to another person – he or she is subject to a “white collar enhancement,” adding up to five years of prison time in addition to the original sentence.
