Penalties for Drug Manufacturing
Drug manufacturing in California is considered a felony that is punishable by three, five, or seven years in prison and a maximum fine of $50,000. Furthermore, if children under 16 years of age live in, are present in, or are harmed in the location where the drugs are made, an additional five-year consecutive prison term will be imposed upon conviction.
If the drug being manufactured contains methamphetamine, PCP, or GHB, even longer sentences may be imposed. If, in the course of making the drugs, someone is injured or killed, the prison sentence will be extended as well.
Cultivation of Marijuana
Now that marijuana has been legalized, anyone can grow up to 6 plants on their property. There are also ways to be permitted to grow more than this. Getting these permits can require getting state licensing and local/county permitting as well. If you are accused of growing marijuana without the proper licenses and permits you could be looking at charges anywhere from a misdemeanor to a high-level felony.
If you are accused of growing marijuana illegally, they may also accuse you of endangering the environment or other people. Commonly this is with outdoor growing where they may worry about you damaging the water table with nutrients and pesticides. This can also happen with indoor growing if you are using a lot of electricity.
